Warranty Overview
LB conditionally provides a limited warranty on its various products, components, and accessories (collectively, “Products”) that have been ordered from LB (collectively, the “Order” or “Orders”). Any Products eligible for such warranty must be subject to only normal use and service and must not have been subject to misuse, neglect, customer damage, misconfiguration, improper or incomplete set up, or otherwise, damaged; and, provided further there is no indication or evidence of intentional customer tampering or deliberate misuse or damage. LB, shall determine, in its sole discretion, whether or not any Products have defects and not any LB representative, distributor or dealer. In the event that LB determines there is a defect, within the below specified warranty period guidelines, LB’s sole obligation will be to repair or replace, at its sole discretion, the defective Products with the same or similar Products. LB reserves the right to substitute, discontinue, alter or modify any Products or part thereof, at any time without prior notice. In such cases, LB may, at its sole discretion, substitute the warranted Products or provide a refund. No LB representative, distributor or reseller is authorized to assume for LB any other obligations or liabilities in connection with Products, or alter the terms of this warranty in any way. Furthermore, upon any claim approval, replacements are provided once per Product/order.
Warranty Coverage and Periods for Different Product Categories
Depending on the specific model and Product, LB warrants that the Product will be free from manufacturer defects in materials and workmanship for various periods when used under normal conditions. We provide no Product warranty for any regular wear and tear or for any “Exceptions” (see definition below).
Please carefully refer to the below GENERAL warranty summaries for typical categories of Products sold by LB.
IMPORTANT NOTE:
please be aware for each Product: 1) you MUST check the specific warranty timeframe as well as the specific warranty terms and conditions set forth on the relevant Product page on the applicable website that is owned and operated LB (including LushBanners.com), 2) that in the event of any conflict between such terms and conditions and the terms and conditions set forth below, the terms and conditions set forth on the applicable webpage shall control (e.g., without limitation, if the stated warranty timeframe on any such webpage is shorter than what is stated here, the shorter timeframe shall control), 3) all warranty time frames commence from the date that the order for the relevant Product is received by LB, and 4) LB reserves the right at any time, to modify, alter, or eliminate any warranty for any Product at any time.
- Fiberglass Poles: generally carry a limited lifetime warranty for premium flag banners including feather, teardrop, bowhead, rectangular.
- Aluminum Frame Parts: generally carry a 12 month to lifetime warranty.
- Vinyl Banners: generally carry a 3 month warranty. Fabric banners generally carry a 6 month warranty.
- Decals: generally carry a 12 month warranty.
- “Graphic" for Trade Show Displays (i.e., the portion of the Product that carries printed images, text, or picture): generally carry a 12 month warranty.
- Flag Banner Bases: generally carry a 12 month warranty.
- Outdoor Products (canopies, umbrellas, inflatable tents, pole banners): generally carry a 24 month warranty on hardware (i.e., brackets and arms, but not screws) and a 12 month warranty on the graphic (i.e., the portion of the Product that carries printed images, text, or picture).
- Freestanding LED Products (such as curtain lights and backlit modular LED displays): generally carry a 3 to 5 year warranty (again, you are responsible for checking the specific warranty features on the web page for the applicable Product, see IMPORTANT NOTE above).
- Banner Stands: generally carry a 1 month, 12 month, or lifetime warranty of the frame and the graphic (i.e., the portion of the Product that carries printed images, text, or picture), BUT specifically depending on the type of Banner Stand (again, you are responsible for checking the specific warranty features on the web page for the applicable Product, see IMPORTANT NOTE above).
- Pre-Designed Feather Flag Kits (i.e., non-customized or bespoke): both the graphic (i.e., the portion of the Product that carries printed images, text, or picture) and hardware (i.e., brackets and arms, but not screws) generally carry a 6 month Warranty.
- NOTE: This warranty does not apply to any “consumable” and accessory items, including but not limited to complimentary carrying bag/case, water bags, spotlight, screws, bolts, and plastic end caps.
Authorization Required
Please bear in mind that LB must authorize the return of any allegedly defective product, component, or other item, before any returns are commenced and any claim under warranty must be in writing. In addition, any party wishing to make a warranty claim for any given LB product within the specified warranty period, must utilize the “Submit a Service Claim” link available by and through the LB websites and provide all requested information within the ticket submission form (the “Services Ticket”).
NOTE: this warranty does not cover issues or damage caused by us arising from shipping, incorrect Products or parts, customized graphics that are reported after 48 hours of receipt of the applicable Products.
Please note LB reserves the right to further request various supporting documentation, including but not limited to clear, high-resolution, pictures of the alleged defect as part of the Services Ticket process, as reasonably required to verify the claim. Failure to provide the necessary additional information or materials requested by any LB representative may delay or disqualify the claim process.
In connection with the claims process, LB MAY provide you an RMA/Case Number depending on the warranty/claim. This number must be used regarding all correspondence with the claim and in connection with any items shipped to LB for review as part of the claims process. Failure to properly utilize any such RMA number in connection with any shipments back to LB, will result in the disqualification of the claim. Finally please note that in all instances, LB reserves the right to carry out a full inspection of the returned item under any warranty or other claim, before accepting the return or warranty claim.
Warranty Exceptions
This warranty does not apply to any costs, repair or replacement of the Product for the following exceptions but not limited to (collectively, the “Exceptions”):
- Issues or damage arising from normal or customary wear and tear or issues arising from normal periodic maintenance repair, refill, or replacement.
- Issues or damage from abuse, improper or abnormal use, misuse, alterations, improper installation, shipping damages, or accident (including but not limited to accidents arising from customer or other parties’ transportation or shipping).
- Issues or damage arising other than from defects in materials or workmanship, including but not limited to severe weather conditions, and rust caused by moisture.
- Issues or damage arising from natural disasters, including but not limited to fire, earthquakes, smoke, lightning, floods and explosions.
- Issues or damage arising from failure to take timely action to minimize the loss or damage or to give LB timely feedback of notice of defect.
- Issues or damage arising from conditions that are external or separate from the Product, such as electric power fluctuations or failure, repair or attempted repair by anyone not authorized by LB, or failure to follow instructions supplied with the Product.
- Issues or damage arising from connectors or cables will be presumed to have resulted from misuse and will not be covered by warranty.
- Issues or damage arising from caused by non-LB components, products, or items.
- Issues or damage caused by us arising from shipping, incorrect Products or parts, customized graphics that are reported after 48 hours of receipt of the applicable Products.
- Issues or damage arising from color fading, wrinkles on flags, or minor scratches or spots on the applicable Products.
- Issues or damage arising from on occasionally missed or uneven stitched lines.
- This warranty is VOID if any Product has been altered or modified in any unauthorized fashion any way.
- This warranty is VOID for any Products where the serial number has been defaced, modified or removed or there is damage incurred by the customer or its representatives and clientele such as markings, discoloration, scratches, dents, anti-theft device markings, or any other defacement.
- This warranty does not apply to any consumable and accessory items, including but not limited to complimentary carrying bag/case, water bags, spotlight, screws, bolts, and plastic end caps.
- Products that have been damaged as a result of or during shipping are considered “non-warranty” issues. And scratches, dents, or other damage that stem from or are inherent or incident to shipping or transportation are not deemed warrantied usage of any Product.
- While LB uses commercially reasonable measures to LB to protect packages from the mishandling of shipping providers and couriers such as FedEx or UPS, it cannot guarantee that scratches, dents, or imperfections do not arise from shipping incidents, mishandling during shipping, damages from shipping, or reasons otherwise caused by any shipping providers or couriers.
- Any use of our design services including the design of any digital assets, files, or elements carry no warranty.
Warranty Return Shipping Requirements
Any customer seeking any warranty based return for any reason, must prepay all shipping and transportation costs, which will be solely reimbursed if the returned item is covered under warranty. Additionally, the customer making any such return should use packaging and insurance of a nature similar to that used by LB to originally ship the returned item to the customer. Please also note that LB will not accept any shipping charges for any returned items, unless the conditions of the warranty have been satisfied per LB’s discretion.
Limitations
LB is not responsible for damage to or loss of any equipment, property, media, software, data, locations, or related to or arising from the use of any Product. LB shall not be liable for damages, including special, incidental or consequential damages, injuries to people or properties, or specific relief arising out of or in connection with the performance, use, or setup, of any Product. Because some states do not allow the exclusion or limitation of consequential or incidental damages, the above limitation may not apply to you. THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES, WRITTEN OR ORAL, WHETHER EXPRESSED BY AFFIRMATION, PROMISE, DESCRIPTION, DRAWING, MODEL OR SAMPLE. ANY AND ALL WARRANTIES OTHER THAN THIS ONE, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED.
